Terms and conditions
Note: this is a translation for your convenience. The German version of this text is the legally binding one.
1. Scope and contracting party
These terms and conditions apply to all bookings by consumers for nature and forest therapy offerings, workshops, individual sessions and coaching. The contracting party is Sherpadee aka. Dieter Föttinger, Martin-Richter-Str. 13, 90489 Nuremberg, Germany (hereinafter the “provider”). A consumer is any natural person who concludes the contract predominantly for purposes outside their trade, business or independent professional activity.
2. Conclusion of contract
The presentation of offerings on this website does not constitute a binding contractual offer. By submitting a booking or booking request, you make a binding offer to conclude a contract. The contract is concluded when the provider confirms the booking by email or in another text form.
3. Scope of service and changes
The content, location, duration and scope of the service are determined by the relevant offer description and booking confirmation. For good cause, particularly weather, safety or local conditions, the provider may adjust individual programme items, the meeting point or their sequence, provided that the overall nature of the booked service is preserved and the change is reasonable.
4. Prices and payment
The total price in euros communicated at the time of booking applies. The payment method and due date are communicated before the contract is concluded or agreed in the booking confirmation.
5. Cancellation or rescheduling by you
You may cancel a booked appointment free of charge up to 48 hours before the agreed start time or reschedule it by arrangement. If you cancel later or do not attend, the agreed price less any expenses saved is payable unless the appointment can be allocated to someone else. You remain entitled to prove that no loss or a substantially lower loss was incurred. Statutory withdrawal rights remain unaffected.
6. Cancellation or changes by the provider
The provider may cancel or postpone an appointment, particularly due to illness, unsuitable weather, safety risks in the terrain or force majeure. Where possible, an alternative date will be offered. If no reasonable alternative date can be agreed, payments already made for the cancelled service will be refunded without undue delay. Further claims exist only in accordance with the liability provisions in section 9.
7. Health and personal responsibility
The offerings support relaxation, nature experience and personal development. They do not replace medical, psychotherapeutic or other healthcare diagnosis or treatment. Please inform the provider before participating of any health or physical limitations that may be relevant to safe participation outdoors. Medical instructions and prescribed treatments remain unaffected. If in doubt, you should seek medical advice before participating.
8. Conduct and safety on site
You are responsible for bringing clothing and equipment appropriate for the weather and terrain and for following the provider’s safety instructions. Anyone who seriously disrupts the programme, disregards safety instructions or is clearly unable to participate safely may be excluded from further participation. In this case there is no entitlement to a refund insofar as you are responsible for the exclusion.
9. Liability
The provider has unlimited liability for damage arising from injury to life, body or health caused by an intentional or negligent breach of duty, and for other damage caused intentionally or through gross negligence. In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical for the contract. Liability for other slightly negligent breaches of duty is excluded. Mandatory statutory liability remains unaffected.
Natural unevenness, weather and other typical outdoor conditions cannot be completely eliminated. You bear these general risks of everyday life yourself insofar as the provider has not breached a contractual duty.
10. Materials, photographs and video recordings
Materials and exercises provided by the provider are intended solely for your personal use. Publication, reproduction or distribution requires prior consent. Photographs or video recordings of participants will only be made or published with separate consent. Refusing or withdrawing consent will not affect your participation.
11. Right of withdrawal
Information about any statutory right of withdrawal that may apply is provided in the separate withdrawal policy. The contractual cancellation and rescheduling provision in section 5 applies independently of this.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. If individual provisions of these terms are or become invalid, the validity of the remaining provisions remains unaffected; the statutory provision applies in place of the invalid provision.
